Your privacy is and will always be enormously important to us. Our Privacy Notice is designed to provide transparency into our data practices in a format that is easy to read and navigate. Please read the sections below to understand how we collect, use, share, and safeguard your information in order to offer you the most seamless power station experience imaginable.

VigorPool aims to collect a minimum amount of personal data necessary for displaying your in-app energy experience, providing services to you, and for improving your power station products. We are also committed to only share your personal data when needed to operate or service your product, or we will ask for your permission.

Information We May Collect

We may collect information about you directly from you, from third parties, and automatically through your use of VigorPool products and services. Some of the information we collect from you is referred to in this policy as "personal information" or "personal data. Personal information or personal data is data that identifies you or that we can relate to you, such as your name, email address, credit card number and shipping address.

ACCOUNT INFORMATION. When you create a VigorPool account, you may provide us with personal information, including your user ID, email address or phone number, password or other information used for account verification. You may choose to provide us with other information - such as gender, date of birth, occupational information and other similar information.

CONTACT INFORMATION. When you place an order with VigorPool, or contact us for customer service, you may provide us with your contact information including your name, alias, email address, shipping address, billing address and phone number(s). Certain jurisdictions require provision of contact information when activating products, opening online accounts, or under other similar circumstances as required by law, and we may ask for such information that is required for compliance purposes.

PAYMENT INFORMATION. When you place an order with VigorPool or engage in financial transactions by using VigorPool Products and Services, you may provide us with your payment information such as your bank account, credit card number, or debit card number.

Communications. When you contact us, we may collect information about your communications with us, including your contact information, and the time, topic, and content of your communications.

LOCATION INFORMATION. When you activate VigorPool hardware products, or obtain safety/regulatory notifications, you may provide us with geolocation information. In order to provide your location, you may be required to enable certain features of your mobile phone (such as GPS, Wi-Fi, and Bluetooth), which enable VigorPool to identify your location through a variety of means, including GPS location, IP address, or detection by physical on-location Wi-Fi or Bluetooth sensors. If your location is collected through Wi-Fi or Bluetooth sensors of your mobile device or other non-VigorPoolProducts, please be aware that such sensors, and the associated data services, may be provided by a third party, which may access such information for the purpose of providing such data services to VigorPool.

Device-Related Information. When you activate VigorPool products, request for after-sales service or upgrade the firmware, you may provide us with information about your VigorPool device, including model and serial number. Our after-sales team may ask for your battery data to provide the service you requested.

Technical Information. When you visit our webpage or use our mobile applications, you may provide us with technical information about the device running the browser or the application. Such information includes your IP address or device address, web browser and/or device type, the web pages or sites that you visit just before or just after you use a Product or Service, hardware version, and operating system. We also may use these technologies to collect information regarding your interaction with email messages, such as whether you opened, clicked on, or forwarded a message.

When you apply for a position at VigorPool, you may provide us with your educational information, such as your academic degree and graduated school, and employment-related information, such as your former employers and working achievements. We may also collect such information from third party recruiters or websites.

Cookies. We use cookies and other similar technologies (e.g. pixels etc.) on VigorPool websites and online services. Cookies are used to collect information, including personal data, from you. How We May Use Your Information

We use information we collect through VigorPool Products and Services in a variety of ways in providing the VigorPool Products and Services and operating our business. The use of information that we collect includes the following:

● To operate and provide features of the VigorPool Products and Services, to verify and manage VigorPool user accounts, to provide services and information that you request, and to process and deliver entries and rewards in connection with promotions that may be offered from time to time by VigorPool. We will process your personal data in accordance with this Policy and any of your preferences, which are expressed via VigorPool Products and Services, including VigorPool.com and the VigorPool App.

● To maintain and enhance VigorPool Products and Services, to personalize the content you receive and provide you with tailored content that will be of interest to you.

● To understand and analyze the usage trends and preferences, to improve the VigorPool Products and Services, and to develop new products, services, features, and functionality

● To contact you for administrative and informational purposes, including for customer service. We may send direct marketing such as communications, including updates on promotions and events, relating to products and services offered by us and by third parties we work with. If you are an individual or consumer we will only send you direct marketing with your consent or as permitted by applicable law. You may send unsubscribe requests or withdraw your consent at any time.

● To detect, prevent, and respond to fraud, abuse, security risks, and technical issues that could harm our users, us, or the public.

● For any other purposes disclosed to you at the time we collect your information or pursuant to your consent.

● We will aggregate personal data we collect, such as the number and frequency of your visits to our sites and apps, to produce metrics and statistical information. We use aggregate data to help us understand how the site is being used and to improve its usability. We also use it to enhance the quality and availability of products and services we offer.

● To comply with applicable laws, such as laws related to the use of products or opening online accounts.

If you are located in the European Economic Area, we will only use your information when we have a valid legal ground, including when:

● You have consented to the use of your information, for example to send you marketing communications.

● We need to use your information to enter into or perform a contract with you, for example to deliver VigorPool products, to provide map services, or provide you with the customer support and other after-sales services.

● We need to use your information to comply with a legal obligation, for example to comply with a court order, subpoena, or warrant.

● We or a third party have a legitimate interest in using your information. In particular, we have a legitimate interest in using your information to understand and improve our VigorPool Products and Services, and to monitor for and prevent fraud. We only rely on our own or a third party’s legitimate interests to process your information when these interests are not overridden by your rights and interests.

Sharing Your Information

We may share information with:

● Third parties you authorize

● Other third parties as required by law

We limit how, and with who, we share your personal data. Examples of when we may share your information include, payment processing, order fulfillment, product installation, customer service, marketing, financing, service or repair, and other similar services. Show less

We do not sell your personal data to anyone for any purpose, period. The table below illustrates who VigorPool may share your personal data with depending on your interactions with us or purchases you make.

The personal data we collect may be shared between VigorPool and our subsidiaries, affiliates (companies that are owned or controlled by VigorPool, or where we have a substantial ownership interest), third party service providers, channel partners, suppliers, and others when necessary to perform services on our or on your behalf. For example, companies we've hired to provide customer service support or assist in protecting and securing our systems and services may need access to personal data to provide those functions. In such cases, these companies must abide by our privacy and data protection requirements and are not allowed to use personal data they receive from us for any other purpose.

In addition, we may share information with:

Third party service providers and channel partners to provide services such as website hosting, data analysis and storage, payment processing, order fulfillment and product installation, wireless connectivity to VigorPool products, information technology and related infrastructure, customer service, product design, product diagnostics, maintenance or related services, email delivery, credit card processing, auditing, marketing, voice command processing, and other similar services.

Subsidiaries and affiliates (such as VigorPool Insurance Services, Inc.) to develop new and improve existing products and services, perform data analysis, and reporting. For example, in the event you request service/repair of your products from a service center or body shop that is operated either by VigorPool or by a third party, we may share information about your product, repair, and associated personal data to optimize your experience, accurately price repairs, and improve our business practices.

Repair estimate providers and any insurance company to enable VigorPool or third party service centers to perform services on your product such as repair or maintenance. When you request VigorPool to perform certain services, we share limited information about you and the product with these parties to help provide you with an accurate repair estimate and to facilitate payment. Repair estimate providers may use this information in the aggregate to create and publish industry analytics.

Other third party business partners to the extent that they are involved in the purchase, lease, or service of your VigorPool products. We share limited information from or about you or your VigorPool products to allow you to take advantage of those services if you elect to utilize them, with such partners as finance institutions, leasing, registration, title companies, electric utilities, permitting authorities and insurance companies.

Third parties you authorize, such as:

● Certified installers, where we may directly or indirectly sell you the energy products that you have requested, or where the Certified Installer owns or is financing your energy products.

● Third party utilities or energy services companies, where required by tariff or regulation or you have agreed to allow them to monitor or control your energy product.

● With third party service centers or providers, if you choose to utilize them. Note that some information about you is stored on certain VigorPool products and may be accessible directly to the third party service centers or providers that you choose to utilize to diagnose or service your VigorPool product.

● Third-party sponsors of contests and similar promotions, if you elect to participate; With your social media account provider, if you connect your VigorPool Account and your social media account. If you do so, you authorize us to share information with your social media account provider and you understand that the use of the information we share will be governed by the social media account provider’s privacy notice.

Third parties when required by law or other circumstances, such as:

● To comply with a legal obligation (such as subpoenas or other court orders); in response to a lawful request by governmental authorities conducting an investigation, including to comply with law enforcement requirements and regulator inquiries; to verify or enforce our policies and procedures; to respond to an emergency; to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical or legally actionable; or to protect the rights, property, safety, or security of our products and services, VigorPool, third parties, visitors, or the public, as determined by us in our sole discretion.

● With your employer or other fleet operator or the owner of the VigorPool product, if you do not directly own it, as authorized by local law.

● In some jurisdictions, VigorPool participates in government programs voluntarily or where required by law, such as incentive or credit programs related to environmental goals, energy reduction, or introduction of new technology. VigorPool’s participation assists us and governments to scale investments and support introduction of our technologies including electric storage, and charging. Participation in some programs may require that VigorPool share certain limited product information and energy generation, charging, or storage information such as product identification number or home address with government or regulatory agencies as dictated by the terms of these programs.

● When you accept a government-offered purchase incentive or otherwise participate in government incentive programs, VigorPool may be required to provide some information to government, or its designated administrators, pertaining to your purchase, participation and eligibility in order to process the purchase incentive. 

● With a third party in connection with any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any insolvency or similar proceedings).

We may also automatically record certain information from your device by using various types of technology, including “clear gifs” or “web beacons” (together with cookies, “cookies and similar technologies”). Cookies Use when You Use Mobile Devices

Cookie Use Without a VigorPool Account or After Your Logout

We still use cookies if you do not have a VigorPool account or have logged out your account. After your logout, we will use cookies to:

California Privacy Notice

This California Privacy Notice supplements the information and disclosures contained in our Privacy Policy. It applies to the Personal Information of certain California residents, who are Consumers receiving products or services for which we are a Business, as those terms are defined under the California Consumer Privacy Act of 2018 (California Civil Code §§ 1798.100 to 1798.199) and its implementing regulations, as amended or superseded from time to time (the “CCPA”), and is effective upon the date that the CCPA enters into operation.

Briefly, and as more fully defined in the CCPA, Personal Information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Consumer or Household; however, certain categories of information may be excluded, including, for example, de-identified or aggregate information, information lawfully made available from government records, medical information, data subject to HIPAA, data maintained by healthcare providers in the same manner as data subject to HIPAA, clinical trial data, consumer credit reporting agency data or data subject to the Fair Credit Reporting Act, data subject to the Gramm-Leach-Bliley Act, data subject to the Driver’s Privacy Protection Act, and data relating to product ownership or warranty information.

Any capitalized terms herein are intended to have the same meaning as in the CCPA.

California Consumers’ Rights and Choices

If you are a Consumer, California law may permit you to request information regarding the:

● Categories of Personal Information (as defined by applicable California law) collected, sold or disclosed by us;

● Purposes for which categories of Personal Information collected by us are used;

● Sources of information from which we collect Personal Information; and

● Specific pieces of Personal Information we have collected about you.

In addition, if you are a Consumer you may:

● Opt-out of the sale or disclosure of your Personal Information, in some circumstances;

● Opt-out of receiving marketing communications from us; however, you may still receive administrative communications regarding the Services;

● Opt-in to certain financial incentive programs we may offer related to the collection, sale, or deletion of your Personal Information; and

● Request deletion of your Personal Information by us and our service providers, in some circumstances.

Further, California law provides Consumers with the right not to receive discriminatory treatment by a business for the exercise of these rights regarding Personal Information.

VigorPool uses administrative, technical, and physical safeguards to protect your personal data, taking into account the nature of the data and the threats posed. VigorPool has implemented a variety of safety and security features to consistently protect your information. For example, your VigorPool Account includes owners resources, guides and important documents, so we offer multi-factor authentication to protect your account.

We also implement other appropriate technical and organizational measures to help safeguard and secure your personal data. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure or compromised, please immediately notify us by using the contact information below.

This Notice does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any site or service to which we may link to on this Notice. The inclusion of such a link does not imply endorsement of the linked site or service by us or by our affiliates, nor does it imply an affiliation with the third party. Additionally, we are not responsible for the collection, use, or disclosure policies and practices (including the data security practices) of other organizations, such as any other app developer, app provider, social media platform provider, operating system provider, or wireless service provider, including any information you disclose to other organizations through or in connection with our software applications or social media pages. In addition, our products and services are not directed to individuals under the age of sixteen, and we request that such individuals not provide any information to VigorPool.

This Notice sets out the essential details relating to your personal data relationship with VigorPool. From time to time, we may develop new capabilities, features, or offer additional services which may require we make material changes to this Notice. When we do, we’ll let you know by revising the date this Notice was last updated on our website. Other times, we may provide you with additional notice (such as an email) with more information about the revisions.
